Booking Terms & Conditions

Thank you for choosing to dine at Soi 38. By making a reservation, visiting our venue or using our booking services, you agree to the following Terms & Conditions.
Communication & Privacy
By making a reservation, you consent to receiving booking-related communications from Soi 38 via email, SMS, phone call or other electronic means. These communications may include booking confirmations, reminders, reservation updates and post-visit correspondence.
If you no longer wish to receive communications from us, please contact the restaurant directly and we will remove your details from our database in accordance with our Privacy Policy.
Reservations
All reservations are subject to availability and confirmation by Soi 38.
We reserve the right to amend, relocate or cancel reservations where necessary due to operational requirements, unforeseen circumstances or events outside our reasonable control.
All reservations will be allocated to the most suitable available table at the time of booking. While we will always do our best to accommodate seating requests, specific tables cannot be guaranteed.
Reservation Duration
Lunch Service
All lunch reservations are allocated a dining period of up to 2 hours unless otherwise arranged.
Dinner Service
Reservations before 7:30pm are allocated a dining period of up to 2 hours and may be rebooked following your reservation.
Groups of 6 or more guests are allocated up to 2 hours and 15 minutes.
Reservations from 7:30pm onwards are generally not rebooked.
Guests requiring additional time are encouraged to contact the restaurant prior to booking. While we cannot guarantee extended dining times, we will do our best to accommodate requests.
Group Dining & Tasting Menus
Lunch
Groups of 5 or more guests are required to either:
Select one of our tasting menus; or
Order dishes to share with a minimum of one dish per person.
Dinner
Groups of 5 or more guests are required to dine on one of our tasting menus.
Children may be exempt from tasting menu or minimum order requirements at the discretion of the restaurant.
We reserve the right to apply minimum spend requirements or special menu conditions for large groups, private events and special occasions.
Credit Card Guarantee & Cancellation Policy
Certain reservations require a valid credit card to secure the booking.
A credit card guarantee is not a deposit and no funds will be charged at the time of booking unless otherwise specified.
Cancellation fees may apply where:
A booking is cancelled within the cancellation period (12 hours prior to the booking time);
Guests fail to attend their reservation;
Guests arrive more than 20 minutes late without notifying the restaurant;
Guest numbers are significantly reduced without reasonable notice;
Group bookings fail to comply with applicable menu requirements.
Applicable cancellation fees are displayed during the booking process and may vary depending on booking date, group size, event type or dining experience.
Repeated no-shows or late cancellations may result in future reservations being declined.
Changes to Guest Numbers
Please notify us as soon as possible if your guest numbers change.
We cannot guarantee availability for additional guests added after a booking has been confirmed.
Where guest numbers are reduced without reasonable notice, applicable cancellation fees may be charged.
All children must be included in the total guest count at the time of booking.
Late Arrivals
If you are running late, please contact us as soon as possible.
We will generally hold your table for up to 15 minutes after the reservation time.
Guests arriving more than 20 minutes late without notice may have their reservation released and cancellation fees may apply.
Where only part of a group arrives on time and the remaining guests are significantly delayed, we reserve the right to proceed with the booking based on the number of guests present and apply cancellation fees where appropriate.
Seating Requests
Parties of two may be seated at our bar.
If bar seating is unsuitable, please notify us when making your reservation and we will do our best to accommodate your request.
Seating requests are not guaranteed and remain subject to availability.
Dietary Requirements & Allergies
We will make every reasonable effort to accommodate dietary requirements and allergies that are communicated prior to your visit.
Due to the nature of our kitchen operations, shared preparation areas and supplier practices, we cannot guarantee that any dish will be completely free from allergens.
Dietary requirements or allergies not disclosed prior to arrival may not be able to be accommodated.
Guests with severe allergies or medical dietary requirements should contact the restaurant before making a reservation.
Children, Prams & Accessibility
Please include all children when making your reservation.
Our venue has limited space for prams and only certain tables can accommodate them. Guests planning to bring a pram should advise us when making their booking.
Please note:
High chairs are not available.
Baby changing facilities are not available.
Some menu items may not be suitable for modification to accommodate children's preferences.
Menu Availability & Pricing
Menus, menu items, ingredients, beverage offerings and prices are subject to change without notice.
While every effort is made to maintain menu consistency, certain dishes or beverages may become unavailable due to seasonal supply, market conditions or unforeseen circumstances.
Images used on our website, social media and marketing materials are representative only.
Outside Food & Beverage
Outside food and beverages are not permitted unless approved in advance by management.
Celebration cakes may be permitted with a cakeage fee of $5pp.
Guests are permitted to BYO wine with a corkage fee of $30 per bottle.
Responsible Service of Alcohol
Soi 38 operates in accordance with all applicable liquor licensing laws.
We reserve the right to refuse the sale or service of alcohol to any person in accordance with responsible service obligations.
Guests who are intoxicated, disorderly, aggressive or behaving inappropriately may be refused service and asked to leave the premises.
No refund or compensation will be provided in these circumstances.
Public Holiday Surcharge
A surcharge of 15% applies on public holidays.
This surcharge helps offset increased staffing and operating costs associated with public holiday trading.
Special Events & Promotional Dining Experiences
From time to time, Soi 38 may host ticketed events, wine dinners, collaborations, tasting events and promotional dining experiences.
Additional terms, menu requirements, payment conditions and cancellation policies may apply to these events and will be communicated at the time of booking.
Where specific event terms differ from these Terms & Conditions, the event-specific terms will prevail.
Force Majeure
Soi 38 will not be liable for any delay, cancellation or failure to perform its obligations where such failure arises from circumstances beyond its reasonable control, including but not limited to natural disasters, government restrictions, utility failures, industrial action, pandemics or other unforeseen events.
Limitation of Liability
To the maximum extent permitted by law, Soi 38 excludes all liability for loss, damage or injury arising from the use of its services, reservations or attendance at the venue, except where liability cannot be excluded under Australian Consumer Law.
Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies available under applicable consumer protection legislation.
Right to Refuse Service
Soi 38 reserves the right to refuse service, cancel reservations or remove guests from the premises where necessary to protect the safety, comfort and enjoyment of guests and staff, or where these Terms & Conditions are breached.
