Acceptance of Terms
Payment of the required event deposit constitutes acceptance of these Terms & Conditions and forms a binding agreement between the booking organiser and Soi 38.
The booking organiser accepts responsibility for ensuring all guests attending the event comply with these Terms & Conditions where applicable.
Booking Confirmation & Deposit
Bookings are confirmed only upon receipt of the required deposit.
Deposit amounts will be advised at the time of booking and will be deducted from the final account.
Event deposits are non-refundable.
Guest Numbers
Final guest numbers must be confirmed no later than 7 Days prior to the event.
This confirmed number will be regarded as the minimum number attending and charges will be based on these numbers regardless of any subsequent reduction in attendance.
Where guest numbers increase after confirmation, every reasonable effort will be made to accommodate the additional guests; however, this cannot be guaranteed.
Menu Selection
Final menu selections and all dietary requirements must be confirmed at least 72 hours prior to the event.
Should menu selections not be received by this time, Soi 38 reserves the right to determine an appropriate menu on behalf of the group.
Menus are seasonal and subject to change based on produce availability. Where necessary, suitable substitutions may be made at the discretion of the kitchen.
Dietary Requirements
Soi 38 is pleased to accommodate most dietary requirements with advance notice.
Whilst every reasonable effort will be made to cater for dietary requirements, we cannot guarantee an allergen-free environment.
Shared Dining
Our menus are designed to be enjoyed as a shared dining experience and are served progressively throughout your event.
Individual menu modifications beyond confirmed dietary requirements may not be possible on the day of your event.
Beverage Packages
Beverage packages commence at the agreed event start time and conclude at the nominated finish time.
Additional beverage package time may be purchased, subject to venue approval.
Alcohol service is subject to Responsible Service of Alcohol legislation.
Exclusive Venue Hire
Exclusive venue hire pricing is determined by the agreed day, time and area reserved.
Where a minimum food and beverage spend applies, any difference between the agreed minimum spend and the final account will be charged as venue hire.
Friday and Saturday dinner bookings are generally limited to groups of 18 guests, unless otherwise agreed as part of an exclusive venue hire arrangement.
Event Duration
Unless otherwise agreed, event durations are:
Lunch: Up to 3 hours
Dinner: Up to 4 hours
Additional time may be available by prior arrangement and may incur additional charges.
Guests arriving significantly later than the scheduled commencement time may require amendments to the service schedule at the discretion of the restaurant.
Cancellations
All cancellations must be made in writing.
Deposits are non-refundable.
Should an event be cancelled within 14 days of the scheduled event date, Soi 38 reserves the right to recover any costs already incurred, including food, beverage and staffing commitments.
Venue Styling & Decorations
Decorations are welcome by prior arrangement.
Confetti, glitter, smoke machines, open flames, wax candles, adhesive materials or any item likely to damage the venue are not permitted unless approved in writing.
Venue access for styling or supplier deliveries must be arranged in advance and is subject to operational requirements.
External Food & Beverage
No external food or beverages may be brought onto the premises without prior written approval.
Celebration cakes are welcome. Cakeage charges apply.
BYO wine is not available unless expressly approved by Soi 38. Corkage charges will apply where permitted.
Entertainment
Any external musicians, DJs, performers or audio equipment must be approved by Soi 38 prior to the event.
Entertainment must comply with all licensing requirements and venue noise restrictions.
Photography & Filming
From time to time, photographs and video may be taken within the venue for promotional and marketing purposes, including use on Soi 38's website, social media channels and printed material.
If the booking organiser or any guest does not wish to appear in photography or video, this must be advised prior to the commencement of the event. Every reasonable effort will be made to accommodate these requests.
Photography for personal use is welcome. Any commercial photography, filming or content creation intended for advertising, marketing or publication must receive prior written approval from Soi 38.
Damage & Cleaning
The booking organiser accepts responsibility for any loss or damage caused by guests attending the event.
Any repair, replacement or additional cleaning costs resulting from damage beyond normal wear and tear may be charged to the booking organiser.
Guest Conduct
The booking organiser is responsible for the conduct of all guests attending the event.
Guests must comply with all reasonable directions provided by venue management.
Soi 38 reserves the right to refuse entry, refuse service or remove any guest whose behaviour is intoxicated, abusive, threatening, discriminatory or likely to compromise the safety, comfort or enjoyment of other guests or staff.
Responsible Service of Alcohol
Soi 38 operates in accordance with Responsible Service of Alcohol legislation.
Management reserves the right to refuse alcohol service to any guest at its discretion.
No refunds or compensation will be provided where alcohol service is refused in accordance with RSA obligations.
Payment
Unless otherwise agreed in writing, payment of the confirmed event value is required no later than 7 days prior to the event date.
The confirmed event value is based on the final confirmed guest numbers, selected menu and any agreed beverage package.
Any additional charges incurred during the event, including additional guests, beverages, menu upgrades, extended beverage packages or other incidental purchases, must be paid in full at the conclusion of the event.
Failure to make payment by the due date may result in cancellation of the booking at the discretion of Soi 38, with any deposit paid being forfeited.
Public Holidays
Public holiday surcharges apply in accordance with applicable legislation.
Personal Property
Soi 38 accepts no responsibility for the loss of or damage to gifts, decorations, styling items or personal belongings brought onto the premises.
Items left at the venue after the event remain at the owner's risk and may be disposed of after 14 days unless alternative arrangements have been made.
Weather
Where an event includes the use of outdoor or alfresco areas, Soi 38 reserves the right to relocate guests to an alternative suitable area should weather conditions or operational requirements require.
Children
Children attending private events must remain under the supervision of a responsible adult at all times.
For the safety of guests and staff, children must not enter service areas or run throughout the venue.
Seating Plans
Where applicable, final seating plans must be provided at least 72 hours prior to the event.
Where no seating plan is provided, seating arrangements will be determined by Soi 38.
Suppliers
Meals for photographers, entertainers or other third-party suppliers are not included unless confirmed as part of the event booking.
All external suppliers must comply with reasonable directions from venue management.
Liability
To the maximum extent permitted by law, Soi 38 accepts no liability for any loss, damage or injury arising from the actions of guests or third-party suppliers engaged by the booking organiser.
Nothing in these Terms & Conditions excludes any rights or guarantees provided under the Australian Consumer Law.
Force Majeure
Soi 38 shall not be liable for any failure to perform its obligations where circumstances beyond its reasonable control prevent the event from proceeding, including but not limited to natural disasters, government restrictions, utility failures, industrial action or other unforeseen events.
Right to Refuse Bookings
Soi 38 reserves the right to decline or cancel any booking where the proposed event is considered unsuitable for the venue, may compromise the safety of guests or staff, or may adversely affect normal restaurant operations.
